Terms & Conditions

PRICING
All prices are subject to change without notice. Orders will be processed at the price prevailing at the time of order. Partial shipment of an order shall not bind Top Cat Sales and adidas to deliver the remainder of the order at the same prices.

WEBSITE ORDERS
All Top Cat Team Sales website orders are subject to acceptance by Top Cat Sales. Acceptance of orders is conditioned upon Customer’s acceptance of these Terms and Conditions of Sale. The Terms and Conditions contained herein will be the complete and exclusive statement of the terms of the agreement between the parties. Customer’s acceptance of the goods sold hereunder will manifest Customer’s assent to the Terms and Conditions hereof. No addition to or modification of any of these Terms and Conditions will be effective unless made in writing and signed by an authorized representative of Top Cat Sales, LLC. Top Cat Sales, LLC reserves the right to charge a shipping and handling fee of $10 for orders of $10.00 or less.
BACK ORDERS
Top Cat Sales does not track or process back orders. Only items available at the time of the order will be processed and shipped.

SALES TAX
Top Cat Sales will charge appropriate sales tax according to the federal and state sales tax rate. The sales tax amount will be documented on your invoice/receipt at the time of the sale.

NO TRANSSHIPMENT/DIVERSION OF MERCHANDISE
Any merchandise purchased from the Top Cat Sales website is intended for the final user or consumer/team.

TERMS OF SALE
Payment is due at the time of the order. Once payment has been confirmed the item/s is shipped to the appropriate shipping address.

LOSS/DAMAGE IN TRANSIT
Top Cat Sales, LLC and will not be responsible for goods lost or damaged in transit. Any damage or shortage in carton count must be noted on the carrier’s delivery receipt and reported directly to the delivering carrier.
CONCEALED SHORTAGES/OVERAGES
Any shortages/overages in unopened cartons must be reported to Top Cat Sales Customer Service Department within five (5) business days from the date of delivery. Please contact us at sales@TopCatTeamSales.com or call us at 1-248-246-1054 to notify us of the issue. In order to get the shortage or overage corrected, all claims must be accompanied by an invoice and shipping order number and an itemization of all shortages/overages by product code, size, and quantity.




OFFICE HOURS
Top Cat Sales is open Monday through Friday 9:00am to 5:00pm EST.

PACKING ERRORS
Packing errors must be reported in writing within five (5) days of receipt of shipment and must contain the order number. Adjustments can be made only if reported within five (5) business days from date of delivery to the Top Cat Sales Website Customer Service. Please contact us at sales@TopCatTeamSales.com or call us during business hours at 1-248-246-1054 to notify us of the issue/problem.

CANCELLATIONS
Since orders will generally be processed and packaged for shipment the day of the order (or the next business day if ordered after 5:00pm EST) it will be difficult to cancel the order. However, if you contact us immediately, during business hours, we may be able to stop packaging process and refund the purchase. Please note, we cannot guarantee that your order can or will be canceled in time. If your order is processed and shipped, please see our Return Policy.

GENERAL RETURNS POLICY
Any items purchased on this website may be returned within seven (7) days from the date of delivery. Only item/s returned in un-used, new condition in original packaging will be credited. The purchaser must contact Top Cat Sales’ Customer Service via phone (1-248-246-1054) or email (sales@TopCatTeamSales.com) and will be given approval number for returns. All returns must be accompanied by a Return Authorization Form, available from the Customer Service Department. The Return Authorization Number must be clearly marked on the outside of the shipping carton and/or on the face of the shipping documents. Any returns not bearing the Return Authorization Number or not accompanied by a Return Authorization Form will be shipped back to Customer at Customer’s Expense. All returns must be shipped prepaid at customer’s expense. Refused product will be subject to a fifteen percent (15%) restocking fee. Additional charges will be assessed for damaged packaging: Footwear packaging that requires reboxing ($5.00/ea.), apparel that requires rebagging ($5.00/ea.) or tagging (3.00/ea.) prior to its return to Top Cat Sales stock. Please note, it may take up to 7 business days before your credit card account is credited.

DEFECTIVE RETURNS POLICY
Whether product is defective will be determined in Top Cat Sales’ sole discretion. Shipping refund will be given upon approval.

RESTRICTIONS ON SALES/PURCHASES/ASSIGNMENT
Customer may not resell adidas products (visible or encapsulated) through the mail, by catalog, by phone or through the use of any computer network, the Internet, the World Wide Web, or any other electronic means (regardless of the medium). Furthermore, customer may not advertise adidas products over the Internet unless such advertisement directs purchase and fulfillment of adidas products specifically at the location(s) approved.

SEVERABILITY; WAIVER; CONSTRUCTION
Any portion of these Terms and Conditions that are found to be unenforceable will not invalidate the remainder of these Terms and Conditions. Any delay in enforcing or any failure to enforce any provision of these Terms and Conditions will not be deemed a waiver of any other or subsequent breach of these Terms and Conditions unless such waiver is in writing and signed by Top Cat Sales and adidas. Caption headings are for convenience of reference only and will not affect the interpretation of these Terms and Conditions. Ambiguous terms will be construed without regard to authorship.



FORCE MAJEURE
If a delivery date is specified, that date will be extended to the extent that delivery is delayed by reason of fire, flood, war, riot, strike, natural disaster, or any other event beyond Top Cat Sales, and adidas’ reasonable control and if, as a result of such a delay, the goods ordered are unavailable, Top Cat Sales, adidas may substitute comparable goods. Additionally, in the event of a freight strike beyond Top Cat Sales and adidas’ control, Top Cat Sales and adidas may ship goods via another carrier without being subject to any penalties.
